Mawqeena · The fine print, in plain words
Terms and Conditions
These Terms apply to mawqeena.com, Mawqeena AI Studio, our website concierge and all our services. They are also published in Arabic. If the two versions differ, the Arabic version prevails (section 31).
Key points
This summary helps you find what matters most. It doesn't replace the full Terms below.
- Who we are. Mawqeena is a web design studio based in Sharjah, United Arab Emirates. You can reach us at any time at hello@mawqeena.com or on WhatsApp at +971 50 392 3733.
- How payment works. You pay a 30% deposit to start. You pay the 70% balance only after you approve your finished website, before we launch it or hand over the files. You never owe the balance for a website you haven't approved.
- Refunds. If you cancel before work begins, we refund your deposit in full. Once work has begun, we keep only the part of the deposit that fairly reflects the work done, refund the rest and show you how we worked it out. If we don't deliver what we agreed, you're entitled to a refund (section 11).
- Mawqeena AI Studio. Building a draft, previewing it, sharing it and 2 AI edits are free. More AI edits need the 30% deposit, and downloading or publishing your website needs full payment. Drafts are deleted 30 days after their last change, or 90 days once paid in full, and can't be recovered.
- AI can make mistakes. Drafts, AI edits, AI-assisted copy and AI photos are generated by AI. Check every detail before you publish. We don't use your content to train AI models.
- Your content. What you give us stays yours. You must have the right to use it, including the permission of anyone who appears in your photos.
- Ownership. Once you've paid in full, the website we made for you is yours. We keep our own tools, templates and know-how.
- After launch. We fix defects in our work free of charge for 30 days. Updates are priced in credits (1 credit = AED 100), and every package includes 3 credits for updates.
- Third parties. Your domain is registered in your name. Hosting providers, WhatsApp, payment gateways and other outside services follow their own terms.
- Your rights. Nothing in these Terms limits your rights under UAE consumer protection law. If we can't resolve a complaint, you can contact the UAE Ministry of Economy and Tourism, the Sharjah Economic Development Department or the economic development department of the emirate where you live, or go to the courts of Sharjah.
1. About these Terms #
1.1 What these Terms cover. These Terms and Conditions ("Terms") apply when you visit or use mawqeena.com, including Mawqeena AI Studio, our website concierge and our demo websites, and when you buy any of our services. They form a binding agreement between you and us.
1.2 Who we are. "Mawqeena", "we", "us" and "our" mean Mawqeena (موقعنا), a web design studio based in Sharjah, United Arab Emirates. Our contact details are:
- Email: hello@mawqeena.com
- WhatsApp: +971 50 392 3733
- Website: https://mawqeena.com
1.3 Who "you" are. "You" means the person using our website or services. If you use them for a business or for someone else, "you" also includes that business or person (section 3.2).
1.4 What else is part of our agreement. Together with these Terms, our agreement includes:
- our Privacy Policy, which explains how we handle personal data;
- the description of your package and any add-ons on our website at the time you accept your quote; and
- for paid work, the written quote you accept and any changes we both later confirm in writing.
1.5 If documents differ. For a particular project, your accepted quote comes first, then these Terms, then summaries on our website, such as package cards, FAQ answers and the short version of these Terms on our homepage. A quote can add to or adjust these Terms for that project, but it never takes away rights the law gives you.
1.6 Your legal rights. We give every customer, whether an individual or a business, the protections of UAE consumer protection law. Nothing in these Terms excludes or limits a right that the law doesn't allow to be excluded or limited. This includes your rights under UAE consumer protection law and, if you live outside the UAE, under the mandatory consumer protection laws of your country.
1.7 Keeping a copy. You can save or print these Terms at any time. The current version is always at mawqeena.com/terms/. Earlier versions stay available at mawqeena.com/terms/ followed by their version number, for example mawqeena.com/terms/2026-10-17/, and we'll send you any earlier version on request.
2. Definitions #
In these Terms:
- Add-on means an optional extra service, such as copywriting, an extra page or an Arabic version.
- AI Output means text, images, layouts, suggestions and other material generated by artificial intelligence through our services. It includes Studio drafts, AI edits, AI-assisted copy, AI photos and concierge answers.
- Approval means your confirmation that your finished website is ready to launch or hand over (section 13.6).
- Balance means the remaining 70% of a project price.
- Concierge (Mawqeena Concierge) means the chat assistant on our website.
- Credit means our pricing unit: 1 credit = AED 100.
- Deliverables means what we create and deliver for your project: the final website design, its code and files, and the copy we write for you.
- Deposit means the first 30% of a project price. It's an advance payment towards the price and is deducted from it. It isn't a payment for the right to withdraw: if you cancel, section 11 decides what you get back.
- Draft means a website version created in the Studio.
- Edit key means the secret key, saved in your browser, that lets you edit a Studio draft. We store only a scrambled (hashed) copy of it.
- Fix period means the period after launch or handover during which we fix defects free of charge (section 14).
- Handover means giving you your website's files, including by download from the Studio.
- Launch means publishing your website so it can be visited on the internet.
- Mawqeena Materials means our own tools, software, templates, components, design systems, code libraries, prompts, methods and know-how, including the Studio and its website renderer. It covers material that exists independently of your project and material we develop for general use.
- Package means one of our fixed-price website packages: Launch Lite, Launch Basic, Launch Plus, Launch Store or Launch Premium.
- Project means the work described in a quote you have accepted, or a Studio draft for which you've paid a deposit or full payment.
- Quote means our written confirmation, sent on WhatsApp or by email, of a project's scope, price, payment schedule and estimated timeline.
- Revision round has the meaning given in section 13.1.
- Services means everything we provide. This includes our website, the Studio, the concierge, website design and build, add-ons, publishing, domain and hosting setup, the care plan, support, and custom AI and automation work.
- Share link means a link that lets anyone who has it view a Studio draft.
- Studio means Mawqeena AI Studio at mawqeena.com/studio/.
- Third-party services means services run by other companies, such as hosting providers, domain registrars, WhatsApp, Google Maps, payment gateways and booking tools.
- Working day means Monday to Friday, excluding UAE public holidays.
- Your Content means anything you, or someone acting for you, gives us or uploads. Examples are text, photos, logos, menus, prices, documents, product details, reviews and contact details.
3. Who can use our services #
3.1 Age. You must be at least 18 years old and legally able to enter into a binding contract.
3.2 Acting for a business or someone else. If you use our services for a business, organisation or another person, such as a client or employer, you confirm that you're authorised to accept these Terms for them. The business or person you act for is then bound by these Terms. You're personally bound as well only if you didn't have their authority.
3.3 Accurate details. You must give us accurate contact details and keep them up to date. This includes a WhatsApp number and email address that are yours or that you're authorised to use. We use them to contact you about your website.
3.4 Confirming who you are. Before we accept a paid project, we confirm your identity and contact details, for example by message from the WhatsApp number or email address you gave us. We'll also ask for your full name and, for a business, its legal name and trade licence details. This tells us who we're contracting with and lets us issue correct invoices.
3.5 International sanctions. You may not use our services if economic or financial sanctions laws or decisions that apply to us prohibit us from dealing with you.
3.6 Declining work. We may decline an enquiry or project before we accept it. For example, we may decline if it would break the law or these Terms, or if we don't have capacity. If we decline after you've paid anything, we refund it in full.
4. Accepting these Terms #
4.1 How you accept. You accept these Terms when you:
- tick "I agree to the Terms & privacy" in the Studio, in the website concierge or in our website contact form;
- accept a quote from us; or
- pay us any amount, including a deposit.
If you don't agree with these Terms, please don't use our services.
4.2 Agreeing electronically. Our agreement is made electronically. Ticking a box, confirming on WhatsApp or by email, or paying is legally binding, just as a contract made in person. UAE law recognises contracts and records made by electronic means.
4.3 Records of acceptance. When you sign up in the Studio, we store with your draft the version of these Terms and our Privacy Policy you accepted (one version number covers both) and the date and time you accepted it. If your draft becomes a paid project, we keep a copy of that record (draft reference, version, date and time, and payment stage) with our project records. When you send an enquiry from the concierge or our contact form, your message includes a line confirming that you accepted them and which version. These records, together with our WhatsApp and email messages, quotes, invoices and payment confirmations, are the record of what we agreed.
4.4 When a paid project is agreed. Prices and estimates on our website, in the concierge and in the Studio's package suggestion are information, not binding offers. A paid project is agreed when:
- you accept our written quote and we receive your deposit; or
- for the Studio, we confirm your package and price in writing and we receive your deposit or full payment.
4.5 How long a quote is valid. A quote is valid for 30 days unless it says otherwise.
5. Our services #
5.1 Done-for-you websites. We design and build websites in Arabic, English or both. We offer five fixed-price packages from AED 1,500 to AED 5,000 (section 9), with optional add-ons. Our website lists what each package includes, and your quote confirms it.
5.2 Mawqeena AI Studio. The Studio lets you create a one-page website draft with AI. It works from your answers, your logo and photos and, if you like, a menu or brochure in PDF or Word. If you need more, such as more pages, a catalogue or bookings, the Studio suggests a package and we confirm the scope with you. Section 7 explains how the Studio works.
5.3 Website concierge. The concierge is a chat assistant that answers questions about our services and helps you prepare an enquiry.
- How it answers: it works in a guided mode with prepared answers or, when available, in a live mode in which an AI model answers your questions.
- Sending us an enquiry: you give your name, phone number and email and tick that you agree to these Terms. The enquiry then opens in your own WhatsApp, and nothing is sent until you press Send there.
- Its limits: the concierge can make mistakes. It can't confirm prices, delivery dates, payments, refunds or special requirements. Only our team can do that, in writing.
5.4 Publishing, domains, hosting, security and care. On request, we publish your website, help you register a domain, and set up hosting and security such as SSL certificates. We can also look after your website through our monthly care plan. Sections 15 and 16 explain how these work.
5.5 Custom AI and automations. We build custom AI assistants, WhatsApp flows and connections with other systems on request.
- Scope: we quote them after a consultation, under a separate written scope that adds to these Terms.
- Providers: they follow the terms and privacy policies of the AI and messaging providers they use.
- Usage fees: those providers bill their usage fees to you directly, unless your quote says otherwise. Examples are AI usage and the official WhatsApp Business API.
5.6 Demo websites. The demo websites on mawqeena.com are examples. Bookings, orders, prices and assistant replies inside them aren't real services. Nothing you type into a demo is sent to us or anyone else.
5.7 What we are not. We design and build websites. We aren't lawyers, accountants, business consultants or a licensing authority. Nothing we say or build is legal, tax, financial or business advice.
6. Quotes, project stages and payment schedule #
6.1 A done-for-you project, step by step.
- Enquiry. You tell us what you need, through the concierge, our contact form, WhatsApp or email.
- Quote. We send you a written quote on WhatsApp or by email. It shows the package and add-ons, the total price in AED, the payment schedule, the estimated timeline and any third-party costs.
- Deposit. You accept the quote and pay the 30% deposit. We start once we've received the deposit and the content we need.
- Design and build. We build your website and send you a preview link.
- Revisions. You review the preview and ask for the revision rounds included in your package (section 13).
- Approval and balance. When you're happy, you approve the website and pay the 70% balance.
- Launch or handover. We publish your website on your domain or hand over the files. The fix period then starts (section 14).
6.2 A Studio project, step by step.
- Free draft. You build a draft, preview it, share it and make 2 AI edits free of charge.
- Deposit. To keep editing with AI, you pay the 30% deposit for the package we confirm with you. This unlocks up to 30 more AI edits (more on request), a review by a Mawqeena designer and preparation for launch.
- Balance. You pay the 70% balance to download your website or have us publish it.
- Launch or download. The fix period starts (section 14).
You may also pay the full price at once.
6.3 Payment schedule.
| Payment | Amount | When it's due | What it covers |
|---|---|---|---|
| Deposit | 30% of the project price | When you accept the quote. In the Studio, when you want to keep editing with AI after your free AI edits | Starts the work and covers work as it's done |
| Balance | 70% of the project price | After you approve the finished website, before launch or handover | Launch or download, and ownership of your website |
Your quote and invoices show the amounts. Add-ons you order with your project are part of the project price and follow the same schedule. Updates after launch and the care plan are paid as set out in sections 9 and 16.
6.4 Changes to the scope. If you'd like something that isn't in your quote, we'll first tell you its cost in credits and any effect on the timeline. We only do extra work after you approve it in writing.
7. Mawqeena AI Studio #
7.1 Signing up. To build a draft, you give us a WhatsApp number from the UAE or any other country and an email address. You also tick that you agree to these Terms and our Privacy Policy. There are no passwords or user accounts.
7.2 What's free. Without paying, you can:
- build a first draft and preview it;
- share it using a share link;
- make 2 AI edits; and
- make changes that don't use AI, such as the look, colours, logo size and section order, your own text and contact details, and your photos and logo, with undo and history.
These free features are a standard part of the Studio. They are not a promotion or a time-limited offer.
7.3 After the free AI edits. To keep editing with AI, you pay the 30% deposit for your package. The deposit unlocks up to 30 more AI edits, a review of your website by a Mawqeena designer and preparation for launch. If you need more AI edits, ask us on WhatsApp.
7.4 Downloading and publishing. Downloading your website, or having us publish it on your domain, needs full payment. After full payment:
- Download or publishing: you can download your website as one ready-to-host HTML file, with your images inside and without the preview ribbon. Or we can publish it on your domain at no extra charge. The domain and any paid hosting are third-party costs (section 15).
- WhatsApp number: your website needs a WhatsApp number in its contact section, because its buttons send customers to WhatsApp.
- Footer credit: the file includes a small "Built with Mawqeena Studio" credit in the footer, which you may keep or remove (section 18.8).
7.5 Package suggestion. The Studio builds a one-page website and automatically suggests a package based on your draft. The suggestion is only a recommendation. We confirm your package and price with you in writing before you pay, and you can ask for a different package.
7.6 Drafts are deleted after 30 days. A draft is deleted automatically 30 days after its last change, and every change restarts the 30 days. This also applies to drafts with a deposit. A draft you've paid for in full is kept for 90 days after its last change. Once deleted, a draft can't be recovered, so please:
- keep working on your draft, or contact us, before it expires; and
- download your website, or ask us to publish it, soon after full payment.
If a draft expires after you've paid a deposit, your payment isn't lost. Contact us and we'll continue your project from the details we hold, though we may need to rebuild the draft. If you'd rather stop, section 11 applies.
If a draft you've paid for in full is lost or expires before you've downloaded it or we've published it, whatever the reason, contact us. We'll rebuild it free of charge from the details we hold and deliver it. If you'd rather not wait for that, or if we can't deliver it, we'll refund what you paid.
7.7 Photos, logos and documents. You can add your own photos and logo, which are resized in your browser. You can also add a menu or brochure in PDF or Word, up to 2 MB. We read a document once to extract its text and don't keep the file. Only the text you confirm is saved with your draft. Photos and documents you add before you finish signing up are handled the same way. Our Privacy Policy explains how long uploads are kept and where they're stored.
7.8 AI photos. When capacity allows, a new draft without your own photos may get one AI-generated hero photo at no charge. You can create up to 2 more AI photos per draft, and each uses one AI edit. Section 8.6 explains how you may use them.
7.9 Share links aren't private. Your draft is unlisted: anyone with your share link can view it until it's deleted. That includes its photos and the contact details shown in its contact section. It also shows your draft's package, price and payment status.
- Your contact details: your WhatsApp number and email appear in the contact section by default. You can change or remove them at any time, but you'll need a WhatsApp number on your website to download it.
- Who can see it: only share the link with people you trust. We can't control who they pass it to.
7.10 Your edit access stays on your device. Your draft's edit key is stored in your browser.
- Losing access: if you clear your browser data, change device or browser, or lose your device, you may lose the ability to edit your draft.
- Shared devices: anyone using the same browser profile can open your drafts, so take care on shared devices.
- Getting help: if you lose edit access, contact us with your draft's share link. We can still see your draft and will help you continue, but we can't always restore editing on a new device.
7.11 Daily limits and template mode. Daily limits keep the Studio fair and available. They apply, for example, to AI drafts, AI edits, AI photos, uploads, documents, downloads and summaries sent to us. AI capacity is also limited each day. When it runs out, the Studio builds your draft from your answers using our templates ("template mode"), and we polish it after you order. We may change these limits.
7.12 Sending us your summary. When you're ready for the next step, you can send us a summary of your draft by ticking a separate consent box. The next step might be paying the deposit or balance, publishing, or asking a question. When you tick the box and continue, we receive a copy by email straight away, including your name, WhatsApp number and note. The same summary opens in your own WhatsApp for you to send. If our daily email limit has been reached, only the WhatsApp message is used.
7.13 Recording your payments. After we receive a payment, we mark your draft as deposit-paid or fully paid. The Studio then unlocks the matching features.
8. AI features and AI-generated content #
8.1 Where we use AI. We use AI to:
- generate Studio drafts and AI edits;
- help write copy, which a person then edits;
- create AI photos;
- read the text of documents you upload; and
- answer questions in the concierge's live mode.
These AI models run on Cloudflare Workers AI. We tell you when you're using AI features, and you can reach a person at any time on WhatsApp or by email.
8.2 AI can be wrong. AI Output can be inaccurate, incomplete, out of date or unsuitable, even when it looks convincing. It can also include sample content, such as example reviews, names, prices or opening hours. You must replace that content with real information or remove it.
8.3 Check before you publish. Before you approve, download or publish a website, check every detail. That means names, prices, opening hours, addresses, contact details, claims, offers, licence details and translations. Never publish reviews or testimonials that aren't genuine. Paid projects include a review by a Mawqeena designer, but that review covers design and quality. Only you can confirm that the facts about your business are right.
8.4 Professional topics. Don't rely on AI Output for legal, medical, financial, safety or other professional advice or claims. If your website includes content like this, have it checked by a qualified professional.
8.5 AI Output may not be unique. AI can produce similar text, layouts or images for other people. We don't promise that AI Output is unique or original. We also don't promise that it's protected by copyright or any other right, or that it can be registered as a trademark. Section 18 explains what you own.
8.6 AI photos. AI photos are generated from your business type, city and style, and are designed to contain no text, faces or logos. They're illustrations. They don't show your real premises, products, team or work, so don't use them in a way that could make customers think they do. Some laws, for example in the European Union, require AI-generated images to be disclosed. If such a law applies to you, you're responsible for disclosing them on your website.
8.7 What reaches the AI.
- Never sent to the AI: the WhatsApp number and email you give us at sign-up, and your photos.
- Removed first: before your notes and edit requests reach the AI, we remove email addresses, phone numbers and links from them.
- May be processed: the texts on your website and the document text you confirm may be processed by the AI to build and edit your draft.
Our Privacy Policy explains this in detail.
8.8 No training on your content. We don't use your content to train AI models. Our AI provider, Cloudflare, states that it doesn't use content processed through Workers AI to train AI models.
8.9 No automated decisions about you. Our AI creates design and content suggestions. It doesn't make decisions about you that have legal or similarly significant effects. Prices come from our fixed packages and your quote, not from AI.
8.10 Model rules. The AI models we use are provided under their own licences and acceptable use policies. Section 19 includes the rules that follow from them.
9. Prices, credits and add-ons #
9.1 Prices in AED. Our prices are in UAE dirhams (AED). The price in your accepted quote is fixed for that project unless you change the scope. We may change our published prices, but changes don't affect quotes you've already accepted.
9.2 Packages. Our packages are one-time prices:
| Package | Price | In credits | Deposit (30%) | Balance (70%) | Revision rounds | Estimated delivery |
|---|---|---|---|---|---|---|
| Launch Lite | AED 1,500 | 15 | AED 450 | AED 1,050 | 1 | About 5 working days |
| Launch Basic | AED 2,000 | 20 | AED 600 | AED 1,400 | 2 | About 7 working days |
| Launch Plus | AED 3,000 | 30 | AED 900 | AED 2,100 | 2 | About 10 working days |
| Launch Store | AED 4,000 | 40 | AED 1,200 | AED 2,800 | 2 | About 14 working days |
| Launch Premium | AED 5,000 | 50 | AED 1,500 | AED 3,500 | 3 | About 21 working days |
The features of each package are listed on our website. Launch Plus and Launch Store include everything in Launch Basic, including its 2 revision rounds. Launch Premium also includes 30 days of priority support.
9.3 Credits. We price all our work in credits, at a flat rate of 1 credit = AED 100. Credits are a pricing unit, not money or a stored-value account.
- Credits you buy. You can buy credits at any time and use them for updates and add-ons. You can ask us to refund unused credits you've bought at any time. If you haven't used them within 12 months of buying them, we'll contact you to either use them or refund them.
- Credits included with a package. Every package includes 3 credits (worth AED 300) for updates after launch, at no extra charge. They have no cash value and can't be refunded, exchanged for money or transferred.
- Using credits. Before any work paid with credits, we tell you how many credits it needs. We only do it after you approve.
9.4 Add-ons and updates. You can add these to any package, at the start or after launch:
| Item | Credits | Price |
|---|---|---|
| Small text or image update | 1 | AED 100 |
| Photo gallery | 2 | AED 200 |
| Google Maps and Google Business Profile setup | 2 | AED 200 |
| Speed boost | 2 | AED 200 |
| New section on a page | 3 | AED 300 |
| Booking or enquiry form | 3 | AED 300 |
| SEO boost | 3 | AED 300 |
| Copywriting, one page in English or Arabic | 3 | AED 300 |
| Copywriting, one page in both languages | 4 | AED 400 |
| Monthly care plan | 3 a month | AED 300 a month |
| Extra page (a new full page) | 5 | AED 500 |
| Bespoke interactive form or calculator | 6 | AED 600 |
| Arabic version (a full right-to-left version) | 8 | AED 800 |
| Custom AI and automations | Quoted | On request |
9.5 Copywriting. A copywriting page covers up to about 400 words, an SEO title and description, and 1 revision. A page of more than about 400 words counts as two pages. Copy may be drafted with the help of AI and is then edited by a person. Bilingual copywriting is written in both English and Arabic and isn't a raw machine translation.
9.6 What's not included. Unless your quote says otherwise, our prices don't include:
- your domain name, which is registered in your name and paid to the registrar (typically about AED 50–150 a year);
- paid hosting, if you choose to upgrade from our default cloud hosting, which has no monthly platform fee (billed at cost);
- third-party tools such as booking, CRM or email marketing platforms, which their providers bill directly;
- payment gateway accounts (such as Stripe, Tabby or PayTabs), which are held directly between you and the gateway;
- major custom applications, such as customer portals or multi-vendor platforms, which we quote separately;
- photo shoots and new logo or brand identity design (we polish the photos and logo you provide); and
- AI usage and the official WhatsApp Business API, which those providers bill directly.
With our default setup, your only fixed yearly cost is your domain. We always tell you about third-party costs before you commit. We pass on any that we pay for you at cost, and only with your approval.
10. Payments, invoices and taxes #
10.1 How to pay. We arrange payment with you on WhatsApp, by bank transfer or by payment link. We never ask for card details on our website, in the Studio or in the concierge. Please never type card numbers there.
10.2 Avoiding payment fraud. Only pay using bank details or a payment link sent from our official WhatsApp number (+971 50 392 3733) or from an @mawqeena.com email address. If you receive different payment instructions, contact us before paying.
10.3 No extra fees. We don't add surcharges for paying by card or payment link. We don't charge any fee that isn't shown in your quote. Your own bank or payment provider may charge you for sending money, for example for international transfers or currency conversion. Those charges are between you and them.
10.4 When a payment counts. A payment counts as received when the full amount reaches our account or the payment link provider confirms it.
10.5 Invoices. For each payment, we send you an electronic invoice or receipt in Arabic and English. It shows the amount in AED, what the payment covers, your project's payment schedule and the fix period that applies.
10.6 Taxes. Your quote and invoice state whether value added tax (VAT) applies and whether a price includes it. If VAT applies, it's shown separately on your invoice with our tax registration number. We never charge tax that wasn't shown on your quote. You're responsible for your own taxes. That includes any tax that applies to your business or, outside the UAE, to your purchase.
10.7 Late payments. We don't charge late fees or interest. If a payment is overdue, we may pause work on your project, or hold launch and handover, until it's paid. Section 16.4 covers the care plan.
10.8 Disputed payments. If there's a problem with a payment, please contact us first so we can try to fix it quickly. If you dispute a payment with your bank or card issuer while your project is in progress, we may pause the project until the dispute is resolved. This doesn't affect your right to dispute a payment.
11. Cancellations and refunds #
11.1 You can cancel at any time. Tell us on WhatsApp or by email. What you get back depends on how far the work has gone.
11.2 Before work begins. If you cancel before work on your project begins, we refund your deposit in full. Work begins when we start working on your project after receiving your deposit. For example, that means planning its structure, designing pages or writing copy. We'll tell you when work starts.
11.3 After work begins. If you cancel after work has begun:
- What we keep: we keep the part of the deposit that fairly reflects the work done up to the day you cancel, up to the full deposit. We also keep any third-party costs we've paid for you with your approval, such as a domain registered in your name.
- What we refund: we refund the rest and send you a written breakdown of how we worked it out. Once we've delivered a full first preview of all the agreed pages, the work done will normally equal the deposit.
- If you disagree: you can question the breakdown under section 29.
- The balance: you don't pay the 70% balance. You never owe the balance for a website you haven't approved.
11.4 Studio deposits. For a Studio project, work begins when you use the first AI edit unlocked by your deposit or when our designer review starts, whichever comes first.
- Before then: if you cancel, we refund your deposit in full.
- After that: the rule in section 11.3 applies. We keep the part of the deposit that fairly reflects the AI edits you've used and the review and launch preparation done, up to the full deposit, and refund the rest with a written breakdown. Once we've delivered the designer review and prepared your website for launch, the work done will normally equal the deposit.
11.5 If we don't deliver.
- If we cancel your project for any reason other than your breach of these Terms, we refund everything you've paid for work we haven't delivered.
- If what we deliver has a defect or doesn't match your quote, we'll put it right free of charge (sections 13.4 and 14). If we refuse or fail to put it right, or unreasonably delay doing so, you can choose a refund. That's a partial refund for the deficient part or, if the service wasn't provided or can't be used, a full refund.
- If we're seriously late for reasons within our control, section 12.4 applies.
11.6 After approval. Your website is made to your specifications. Once you've approved it and paid the balance, we don't give refunds just because you've changed your mind. This never affects your rights if the website has a defect or doesn't match what we agreed.
11.7 Credits and add-ons. Add-ons ordered with a project follow the rules above. You can ask for a refund of credits you've bought and not used (section 9.3). Credits used for completed work can't be refunded unless the work was defective and we couldn't fix it. Included credits have no cash value.
11.8 Care plan. You can cancel the care plan at any time (section 16.3).
11.9 Third-party costs. We may already have paid third parties for you, with your approval, such as for a domain registration or a paid hosting term. We can't refund those amounts, but what they bought, such as your domain, is yours. If a third party refunds us, we pass the refund on to you.
11.10 How we pay refunds. We pay refunds in AED to your original payment method or to a bank account in your name. We do this within 14 days of confirming the amount with you. We don't charge a fee for refunds.
11.11 Your statutory rights. This section doesn't limit any right you have under UAE law, including UAE consumer protection law. That includes rights to repair, re-performance, a refund or compensation.
12. Timelines and your responsibilities #
12.1 Estimated timelines. Delivery times are good-faith estimates (section 9.2). They start once we've received your deposit and the content we need. We confirm milestones in writing before we start. Add-ons, bilingual versions and changes to the scope can add time, and we'll tell you if they do.
12.2 What we need from you. To deliver on time, we need you to:
- send the content and information we ask for, such as text, photos, logos, menus, prices, opening hours and contact details;
- answer our questions and review previews within a reasonable time;
- give us the access we need, for example to your domain or Google Business Profile (where possible, add us as a user instead of sharing your password);
- check that everything about your business on your website is accurate and lawful; and
- keep your own copies of your content, since we're a design studio rather than a storage service.
12.3 Delays on your side. If we're waiting for content, feedback, approval or payment from you, the timeline moves by the time we spend waiting.
- Reminder: if a done-for-you project has been on hold waiting for you for more than 60 days, we'll send a reminder on WhatsApp and by email.
- Closing the project: if we still don't hear from you within 14 days of the reminder, we may close the project. Closing a project is treated as a cancellation by you under section 11.
- Restarting: you can ask us to restart a closed project later. We may need to update the quote and schedule.
Studio drafts follow section 7.6.
12.4 Delays on our side. If we're going to miss an estimated date, we'll tell you as early as we can and agree a new date with you. A delay we cause may become unreasonable. If it does, you can end the project and get a refund of what you've paid for work not delivered. If the delay means you can't use the work, you get a full refund.
12.5 Your business, your permits. You're responsible for any trade licence, e-commerce licence, permit, registration or approval your business or website activity needs. That applies in the UAE, at federal and emirate level, and anywhere else you operate or sell. You're also responsible for your VAT and other taxes. Whether you're allowed to run the business your website promotes is between you and the authorities.
12.6 Legal text on your website. Your website may need legal text, such as your own terms of sale, a privacy notice or other required information. You or your advisers must provide or approve it. We can add it to your website, but we aren't responsible for what it says.
13. Revisions, approval and launch #
13.1 What a revision round is. A revision round is one set of changes to the current version of your website. You send the changes to us together in one message on WhatsApp or by email, and we apply them and return an updated preview. Revisions must be within the agreed scope. Examples are corrections, text and photo swaps, and adjustments to colours, layout and the order of existing pages and sections.
13.2 Included rounds. Each package includes the revision rounds shown in section 9.2: 1 for Launch Lite, 2 for Launch Basic, Launch Plus and Launch Store, and 3 for Launch Premium. In the Studio, AI edits and free changes take the place of revision rounds (section 7).
13.3 What isn't a revision. Some changes are new work, which we quote in credits first. These include new pages, sections or features, a new design direction after you've approved one, and changes to parts you've already approved.
13.4 Our mistakes are free to fix. If something doesn't match your quote, the content you gave us or a change you asked for, we fix it at no charge. It doesn't use up a revision round.
13.5 More revisions. If you've used your included rounds and want more changes, we'll quote them in credits first.
13.6 Approving your website. When your website is ready, we'll ask you to approve it.
- How you approve: you confirm on WhatsApp or by email that it's ready to launch or hand over, or you pay the balance.
- How we judge it: whether your website matches what we agreed is judged against your quote, the package description, and the content and change requests you gave us. Neither of us decides that alone.
- If something doesn't match: tell us what it is and we'll fix it before you approve.
13.7 Launch or handover. After you approve your website and pay the balance, we launch it on your domain or hand over the files. For the Studio, you download it or we publish it. Ownership passes to you as set out in section 18.
14. Fix period, warranty and support #
14.1 Our 30-day fix period. We fix any defect in our work free of charge for 30 days from launch or handover, whichever comes first, or for any longer period the law requires. A defect is anything we built that doesn't work as described in your quote and package description. Examples include:
- broken links or buttons we created;
- layout errors;
- forms or features that don't work as agreed; and
- display problems in current versions of major browsers, such as Chrome, Safari, Edge and Firefox, on common phones, tablets and computers.
14.2 Reporting a defect. Tell us on WhatsApp or by email, with a short description and, if possible, a screenshot. We aim to fix the defect within 5 working days of your report. If a fix needs longer, we'll tell you within that time why and when it will be done.
14.3 What the fix period doesn't cover. We tell you about these exclusions before you buy. They apply only to the extent that a problem is caused by them:
- changes made to your website or its files by you or anyone other than us;
- problems caused by your hosting provider, domain registrar or other third-party services, or by changes they make;
- errors in content you provided or approved;
- new features, design changes or new content;
- very old or unsupported browsers or devices, and browsers or devices released after launch that behave differently; and
- misuse, or events outside our reasonable control (section 32.4).
14.4 If we can't fix it. If we refuse or fail to fix a defect, or unreasonably delay doing so, you can choose a refund, as UAE law provides. That's a partial refund for the part that doesn't work or, if the service wasn't provided or can't be used, a full refund.
14.5 Support. During the fix period, we also answer reasonable questions about using your website on WhatsApp or by email. Launch Premium's 30 days of priority support means your requests are handled first.
14.6 After the fix period. Updates and changes are priced in credits, or covered by the care plan if you have one. Any rights you have under the law for defects aren't affected.
15. Domains, hosting and third-party services #
15.1 Your domain. We register your domain in your name, so you own it 100%. Renewals are your responsibility. If you'd like us to handle a renewal, ask us and we'll pass on the registrar's cost.
15.2 Hosting. By default, we publish websites on modern cloud hosting with no monthly platform fee. If you need paid hosting, we'll quote it and bill it at cost. Hosting providers, including free ones, set their own terms, limits and prices and may change them. If we manage your hosting and a provider changes or ends a service your website relies on, we'll tell you the options. We quote in credits any work needed to move your website.
15.3 Your files. After full payment, you can ask for a copy of your website files at any time. You can also ask us to move any hosting we set up for you into an account in your name. A standard handover of your files is free. Moving your website to another provider may be quoted in credits.
15.4 Third-party services. Your website may use or link to services run by other companies. Examples are WhatsApp, Google Maps, Google Business Profile, Instagram, payment gateways, booking tools and hosting providers.
- Their own terms: these companies are independent. They follow their own terms, privacy policies and prices, which can change at any time.
- What we do: we set these services up and connect them to your website as agreed.
- What we're not responsible for: we don't control these services. We aren't responsible for their outages, updates, policy or platform changes, decisions (such as approving or suspending your account) or fees.
- What we remain responsible for: our own setup work (section 14).
15.5 Your accounts with others. Accounts you hold with third parties are between you and them. Examples are a payment gateway, Google Business Profile or WhatsApp Business. You're responsible for meeting their requirements, including any verification they ask for.
15.6 Our own providers. We use Cloudflare to host our website, run the Studio and the concierge, process AI requests, store drafts and route email. We use WhatsApp, operated by Meta, to talk with customers. Our Privacy Policy explains how these providers handle data.
16. Care plan and updates after launch #
16.1 Updates after launch. After launch, message us on WhatsApp for any change. We quote it in credits, you approve, and we do it. When possible, we do small text or image updates the same day. You can use the 3 credits included with your package.
16.2 The care plan. Our optional care plan costs AED 300 (3 credits) a month. It covers updates, backups and health checks each month, as described on our website and confirmed in writing when you start. It's billed monthly in advance, and there's no minimum term.
16.3 Cancelling the care plan. You can cancel at any time on WhatsApp or by email, with no cancellation fee. The plan ends at the end of the month you've already paid for, and we won't bill you again. If we didn't provide the care plan as described in a month, you can ask for a refund for that month.
16.4 Missed care plan payments. If a monthly payment is still unpaid 14 days after we've reminded you, we may pause the care plan until it's paid. Pausing the care plan doesn't take your website offline.
16.5 Care plan price changes. We'll tell you at least 30 days before any change to the care plan price. If you don't agree, you can cancel before the new price applies.
17. Your content #
17.1 You keep ownership. Your Content stays yours. These Terms don't transfer ownership of Your Content to us.
17.2 The permission you give us. You give us a non-exclusive, royalty-free licence, valid worldwide. It lets us do the following with Your Content, only as needed to provide our services to you and for as long as that takes:
- host, store, copy, display and transmit it;
- adapt it, for example resize, crop, compress, translate or format it; and
- process it with AI.
The licence ends when Your Content is deleted from our systems. The only exception is copies we must keep by law or to deal with a dispute.
17.3 Your promises. You promise that:
- you own Your Content or have permission to use it on your website, including licences for any photos, fonts, music or logos you supply;
- you have the consent of every person who appears in your photos, or whose name, details or testimonial appear on your website, and for children, the consent of a parent or guardian;
- Your Content is accurate, not misleading and lawful, including prices, offers, claims, reviews and testimonials; and
- Your Content doesn't infringe anyone's copyright, trademark, privacy or other rights.
17.4 Responsibility for Your Content. You're responsible for Your Content and for content you approve. We aren't responsible for problems that arise from content you provided or approved, except to the extent we caused them. This covers copyright or trademark problems, misleading claims and fines.
17.5 Sensitive information. Please don't send us sensitive information, or type it into the Studio or the concierge. That includes passwords, card numbers, identity document numbers, health or patient information, and other sensitive personal information. If your website needs to collect information like this from your customers, talk to us first.
17.6 Removing content. We may refuse to use content that we reasonably believe breaks the law or these Terms. We may also remove such content from drafts and share links. Where reasonable, we'll tell you why and let you replace it.
18. Ownership and intellectual property #
18.1 Before full payment. Until you've paid in full, the work we create for your project remains ours. That includes designs, drafts, code and copy, but not Your Content. In the meantime, you may view, preview and share drafts to review them. You may not publish, copy or use them commercially.
18.2 After full payment, your website is yours. When we receive full payment for a project, we transfer to you all the economic rights we hold in the Deliverables:
- the rights: to reproduce, adapt and modify, translate, publish, display, communicate to the public (including online) and distribute the Deliverables, and to license or transfer these rights to others;
- the work: the final website design, its code and files, and the copy we wrote for your project, as delivered to you;
- the place: worldwide; and
- the duration: the full period of legal protection.
These Terms and our written confirmation of your full payment are the written record of this transfer.
18.3 What we keep. We keep all rights in the Mawqeena Materials. Where Mawqeena Materials are part of your website, we give you a permanent, worldwide, royalty-free, non-exclusive licence to use, copy and modify them as part of your website and its future versions. You may not sell or distribute them separately. You also may not use them to build templates, website builders or other products that compete with ours.
18.4 Third-party materials. Parts of your website may come from third parties. Examples are fonts (such as Readex Pro, under the SIL Open Font License), open-source code, icons and stock images.
- Their licences: these materials remain under their own licences, which you must follow, including keeping any notices they require.
- Paid licences: we'll tell you before using any component that needs a paid licence.
- The full list: we'll give you a list of third-party components and their licences on request.
18.5 AI-generated material. It is not settled whether AI-generated material is protected by copyright. To the extent any rights exist in AI Output we deliver for your project, they're included in the transfer in section 18.2. Section 8.5 explains why AI Output may not be unique.
18.6 Your freedom to change your website. By law, an author's moral rights, such as the right to be named as the author, can't be transferred. After full payment, we won't use those rights to object to you editing, adapting or removing parts of your website, or removing any credit to us.
18.7 Portfolio. We'd like to show some finished websites in our portfolio, but only with your permission, which we ask for in writing.
- What you allow: if you agree, we may show screenshots or short recordings of your finished, published website, with a link to it, on our website and social media, worldwide, until you withdraw your permission.
- Withdrawing permission: you can withdraw it at any time, and we'll remove the work from places we control within 14 days.
- What we never show: unpublished drafts or confidential information.
18.8 Credits on your website. A downloaded Studio file includes a small "Built with Mawqeena Studio" credit in its footer. After full payment, you may keep or remove it. If a done-for-you website includes a credit to us, you may ask us to remove it.
18.9 Our name and brand. "Mawqeena", "موقعنا", our logo and our package names belong to us. You may not use them without our permission, except to refer to us accurately.
18.10 Your ideas for us. If you send us suggestions about our services, we may use them without any obligation to you. This gives us no rights in Your Content.
19. Acceptable use #
19.1 Lawful use. You must use our services, and any website we build for you, lawfully and in line with these Terms.
19.2 Content we won't create, publish or host. You may not use our services for content that:
- breaks UAE law or the law of any place where the website is offered;
- offends religions, public order or public morals, or disrespects national symbols;
- is defamatory, insulting, threatening, harassing, hateful or discriminatory;
- is sexually explicit, or exploits or endangers children in any way;
- promotes violence, terrorism, human trafficking, self-harm, illegal weapons or illegal drugs;
- promotes gambling, or offers financial, medical, legal or other regulated services without the required licences;
- is fraudulent or misleading, including fake reviews or testimonials, pyramid schemes, and misleading prices or offers;
- impersonates a person, business, brand or government body, or suggests a connection that doesn't exist;
- infringes anyone's intellectual property, privacy or other rights, or shows images or personal details of people without their consent; or
- contains or links to malware.
19.3 Using the Studio, the concierge and our systems. You may not:
- try to get around usage limits, payment steps or security measures, or create drafts in bulk;
- use bots, scrapers or other automated tools to access or copy our services;
- copy, reverse engineer or decompile our software, our templates or the Studio, except where the law allows it;
- try to make our AI produce prohibited content, or reveal its internal instructions or other people's data;
- overload, attack or disrupt our systems or our providers' systems;
- resell access to the Studio, or offer it as your own service, without our written agreement; or
- use the Studio, or output extracted from it in bulk, to develop a competing website builder or to train AI models.
19.4 What we may do. If we reasonably believe that content or use breaks this section, we may:
- refuse to build or publish it;
- remove it from drafts or disable a share link;
- pause your project; or
- end our services under section 24.
Where it's lawful and reasonable, we'll tell you first and give you a chance to fix the problem. Where the law requires, we may report illegal content to the authorities.
19.5 Reporting illegal or infringing content. You may believe that a draft, share link or website we've built contains illegal content or infringes your rights. If so, email hello@mawqeena.com with:
- a link to the content;
- what's wrong, and for infringement, which rights you hold; and
- your contact details.
We'll review your report and may disable the content while we do. We'll also tell the customer concerned so they can respond.
20. Availability and changes to our services #
20.1 Availability. We work to keep our website, the Studio and the concierge available. However, we can't promise they'll always be available, uninterrupted or error-free. They depend on internet connections and on providers such as Cloudflare, and we may pause them for maintenance, security or updates.
20.2 AI capacity. AI features depend on daily capacity and on our AI provider, so they may be slower, limited or temporarily unavailable. When that happens, the Studio may use template mode (section 7.11).
20.3 Changes to our services. We may improve, change or withdraw features of our website and the Studio, including free features. A change may affect a paid project or service you've already agreed. If it does, we'll still deliver what we agreed. If we can't, we'll tell you in advance and refund what you've paid for anything we won't deliver, and you can also cancel that service without penalty.
20.4 Testing improvements. To improve the Studio, some drafts may use a different version of a feature so we can compare which works better. This never changes your price or what you're entitled to under these Terms.
21. Our promises and disclaimers #
21.1 What we promise. We provide our services with reasonable skill and care, in line with your quote, the package description and these Terms.
21.2 What we can't promise. Unless your quote says so in writing, we don't promise:
- business results, such as search rankings, traffic, leads, bookings or sales;
- any particular speed or performance score;
- that Google, Meta or other platforms will approve, list or keep listing your business, website or accounts;
- that AI Output will be accurate, complete, unique or suitable for your purpose (section 8); or
- that free features will be available at any particular time.
21.3 Free features. To the extent the law allows, the free features of the Studio and the concierge are provided as they are and as available.
21.4 Your rights aren't affected. Nothing in this section limits the fix period in section 14 or your rights under UAE consumer protection law.
22. Our liability #
22.1 What we're responsible for. We're responsible for loss or damage you suffer that is a foreseeable result of either of these:
- our breaking these Terms; or
- our failing to use reasonable skill and care.
22.2 What we're not responsible for. We aren't responsible for loss or damage to the extent that it:
- wasn't caused by our breaking these Terms or our failing to use reasonable skill and care;
- results from content you provided or approved (section 17.4), or from how you run your business, including fines, penalties or third-party claims that follow from them;
- is caused by third-party services we don't control (section 22.5); or
- results from your own business decisions, for example publishing AI Output you didn't check (section 8.3).
22.3 No cap on your compensation. We don't cap the compensation we owe you. Nothing in these Terms reduces or cancels the compensation you're entitled to for damage caused by our breach or by a defective service, as UAE consumer protection law provides.
22.4 What we don't limit. Nothing in these Terms limits or excludes our liability for:
- fraud, gross negligence or wilful misconduct;
- death or physical injury we cause;
- anything under UAE consumer protection law that the law doesn't allow to be limited or excluded, including your right to compensation for damage; or
- anything else that the law doesn't allow to be limited or excluded.
22.5 Third-party services. We aren't liable for failures, outages or changes of third-party services we don't control (section 15.4), except to the extent our own work caused the problem.
23. Claims by others caused by your content #
23.1 What you cover. Someone may make a claim against us because Your Content infringes their rights or breaks the law, or because you used our services in breach of section 19. If so, you'll cover the losses and reasonable costs we actually incur as a direct result, to the extent your content or breach caused them. This never makes you liable for more than the actual harm caused.
23.2 How we handle a claim. We'll tell you promptly about any such claim. We'll let you take part in responding to it, and we won't settle it without asking you first.
23.3 What you don't cover. You aren't responsible under this section for anything caused by our own work or our breach of these Terms.
24. Suspension and termination #
24.1 You can stop at any time. You can stop using our services at any time. Sections 11 and 16.3 cover cancelling a paid project or the care plan.
24.2 When we may suspend or end our services. We may suspend or end our services to you, in whole or in part, if:
- you seriously or repeatedly break these Terms, including section 19;
- you don't pay an amount that's due, after we've reminded you and given you at least 14 days to pay;
- the law, a court or a competent authority requires it; or
- continuing would expose us, our providers or other people to serious legal, security or safety risk.
24.3 Notice. We'll tell you in writing first and explain why. If the problem can be fixed, we'll give you a reasonable time to fix it. We may skip this step only if the law prevents it, or if it's urgent, for example to stop illegal content or a security threat.
24.4 What happens next.
- If we end a project because of your breach, section 11 applies as if you had cancelled.
- If we end a project for any other reason, we refund everything you've paid for work we haven't delivered.
- Work you've paid for in full stays yours, and work not paid for stays ours (section 18.1).
- Drafts are deleted under the normal 30-day rule (section 7.6).
- Before we end any service that keeps your website online, we give you the chance to take a copy of your paid website files.
24.5 What continues afterwards. Some parts of these Terms continue after our agreement ends because of their nature. These include payment for work done, ownership and licences, our liability, claims by others (section 23), confidentiality and governing law.
25. Confidentiality #
25.1 What we keep confidential. We keep the information you share for your project confidential, such as your business plans, unpublished content and drafts. We share it only with people and providers who need it to deliver our services, as set out in our Privacy Policy, or when the law requires.
25.2 What we ask of you. Please keep confidential any non-public information we share with you, such as our internal processes or special pricing, unless we agree otherwise.
25.3 Public information. This section doesn't apply to information that is or becomes public through no fault of the person who received it.
26. Privacy, data protection and marketing #
26.1 Our Privacy Policy. Our Privacy Policy explains what personal data we collect, how we use it, who we share it with, how long we keep it and your rights. It forms part of our agreement.
26.2 Your website's visitors. Once your website is live, you're responsible for the personal data of its visitors and customers. That includes any enquiries, bookings or orders it receives. You're also responsible for telling visitors how you use their data, for example in a privacy notice.
We may host or maintain your website, or set up forms or tools that handle your visitors' data. When we do, we act on your behalf, and we:
- use that data only to provide the agreed service;
- keep it confidential and secure;
- help you respond to your visitors' requests; and
- delete or return it when the service ends.
26.3 Marketing messages. Messages about your enquiry, project, payments or the services you use are service messages. We only send marketing messages, such as news about our services, if you've agreed to receive them. You can opt out at any time by telling us on WhatsApp or by email.
27. Changes to these Terms #
27.1 New versions. We may update these Terms, for example when our services, prices or the law change. Each version shows its date and version number at the top, and we'll send you an earlier version on request.
27.2 Notice of changes. If a change materially affects you, we'll tell active customers on WhatsApp or by email at least 14 days before it takes effect, unless the law requires the change sooner. Active customers are those with a project in progress, a care plan or unused credits they've bought.
27.3 Projects already agreed. Changes don't apply to a project you've already agreed with us, unless you agree to them or the law requires them.
27.4 Accepting a new version in the Studio. When we publish a new version, the Studio may ask you to accept it before you continue building. We record your acceptance as described in section 4.3.
27.5 If you don't agree. If you don't agree to a change, you can stop using our services before it takes effect and cancel any ongoing service without penalty. We'll refund what you've paid in advance for services you won't receive, such as unused credits you've bought or future care plan months.
28. Notices and electronic records #
28.1 How we contact you. We contact you using the WhatsApp number and email address you gave us, so please keep them up to date.
28.2 How to contact us. Send notices to hello@mawqeena.com, or on WhatsApp to +971 50 392 3733.
28.3 Electronic messages count as writing. WhatsApp messages and emails count as "in writing" under these Terms. A notice is treated as received when it's delivered to the recipient's WhatsApp or email.
28.4 Records. We keep electronic records of our agreement, and either of us may use them as evidence. These include acceptance records, messages, quotes, invoices and payment confirmations.
29. Complaints and feedback #
29.1 Tell us first. If you're unhappy with anything, please tell us on WhatsApp at +971 50 392 3733 or by email at hello@mawqeena.com. You can send a complaint at any time.
29.2 How we handle complaints. We acknowledge every complaint within 2 working days and give you a reference number so you can follow its progress. We aim to resolve it, or give you a full answer, within 14 days.
29.3 Ratings and feedback. You can rate your experience with us or send us feedback at any time through the same channels.
29.4 Help from the authorities. You can complain to any of these authorities if we can't resolve your complaint, or at any time:
- the UAE Ministry of Economy and Tourism (8001222, moet.gov.ae);
- the Sharjah Economic Development Department (sedd.ae); or
- the economic development department of the emirate where you live.
Using our complaints process doesn't limit your right to go to these authorities or to court.
30. Governing law and disputes #
30.1 Governing law. These Terms, and any dispute about them or our services, are governed by the laws of the Emirate of Sharjah and the applicable federal laws of the United Arab Emirates.
30.2 Resolving disputes. We'll first try to resolve any dispute with you amicably and in good faith (section 29).
30.3 Courts. If we can't resolve a dispute, it will be decided by the competent courts of the Emirate of Sharjah. We don't require you to go to arbitration.
30.4 Your rights are preserved. This section doesn't stop you from:
- complaining to the authorities named in section 29.4;
- using any dispute resolution committee set up under UAE law; or
- relying on protections you have under the mandatory law of the country where you live, including any right to bring a claim in your country's courts.
31. Language #
These Terms are published in Arabic and English, and both versions are intended to have the same meaning. If they differ, the Arabic version prevails.
32. General provisions #
32.1 Entire agreement. These Terms, the documents listed in section 1.4 and your accepted quote are our entire agreement about their subject. They replace earlier discussions about it, except anything we've confirmed in writing as part of your quote. Nothing in this section limits liability for fraud.
32.2 Severability. A court or authority may find part of these Terms invalid or unenforceable. If so, the rest stays in force, and that part applies to the greatest extent the law allows.
32.3 No waiver. If either of us doesn't enforce a right straight away, it can still enforce it later.
32.4 Force majeure and events outside anyone's control. Neither of us is responsible for a delay or failure caused by events outside our reasonable control. Examples are natural disasters, war, epidemics, government action, and major failures of the internet, the power supply or cloud providers.
- What the affected party must do: tell the other promptly and do what it reasonably can to limit the effects.
- If a project stops: if such an event stops a project for more than 30 days, either of us may end the project. We'll then refund what you've paid for work not delivered.
- Court powers: this doesn't limit any power a court has under the law to adjust our obligations.
32.5 Transferring this agreement. We may transfer our rights and obligations under these Terms to another business that takes over Mawqeena, for example as part of a reorganisation of our business. We'll do this only if your rights aren't reduced, and we'll tell you if it happens. You may transfer your rights under these Terms only with our written agreement, which we won't unreasonably refuse. However, once your website is paid for in full, you're free to transfer or sell it.
32.6 Our relationship. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between us.
32.7 Reading these Terms. Headings are for convenience only. Words such as "including" and "for example" don't limit the words before them.
